Terms of Service for Clinics

These Terms of Service (“Terms”) govern the access to and use of Miami Med Spas / Miami Med Spa Leads (“Platform”, “we”, “us”) by medical spas, aesthetic clinics, and wellness providers (“Clinics”).

1. Nature of the Service

These Terms are governed by the laws of the State of Florida, United States.

Miami Med Spa Leads provides a pay-per-lead marketing and patient matching service.
We connect Clinics with prospective patients who have expressed interest in aesthetic or wellness treatments.

We do not provide medical services, medical advice, or guarantees regarding patient outcomes.

• Non-payment
• Misuse of leads
• Breach of these Terms
• Unethical or unlawful behavior

2. Lead Definition

We may suspend or terminate access for:

• Selects a treatment category and geographic area
• Meets basic validation criteria (unique contact, valid information)

Miami Med Spa Leads shall not be liable for indirect, incidental, or consequential damages, including lost revenue or missed opportunities.

Clinics are charged only per delivered lead, as agreed in advance.

Payment terms are agreed separately.
Disputes must be submitted within a reasonable timeframe. Abuse of dispute mechanisms may result in suspension.

• No monthly retainers
• No long-term contracts unless explicitly agreed in writing
• Pricing may vary by treatment type or ZIP code

4. ZIP Code Exclusivity

• Spam or harass leads
• Misrepresent services or pricing
• Use leads for unrelated marketing
• Transfer leads to third parties

When exclusivity is offered and accepted:

Clinics may not:

• Clinics receive exclusive leads within a defined ZIP code
• Exclusivity applies only to the agreed treatment categories
• Exclusivity remains valid while the Clinic is active and in good standing

7. Prohibited Use

We reserve the right to revoke exclusivity if:

• Contact leads promptly and professionally
• Use lead data solely for patient outreach
• Not resell, share, or reuse lead data
• Comply with all applicable healthcare, privacy, and marketing laws
• Maintain accurate business information

• Payments fail or are disputed
• Leads are misused or ignored
• Clinic violates these Terms
